Debt collection litigation in New York is started by the filing of a document detailing the relief requested. In other words, the document details why you are filing the lawsuit and what you are looking to gain. The filed document may be:
1. a summons and complaint,
2. a summons with notice, or
3. a motion for summary judgment in lieu of complaint.
One of the above documents is filed with the Clerk of the Court by purchasing an index number from that Court. The costs vary depending on whether it is a commercial case or a consumer case AND whether the case is being filed in Civil Court or Supreme Court.
The cost for filing a summons in a commercial case:
- Civil Court: $45.00,
- Supreme Court: $210.00.
The cost for filing a summons in a consumer case:
- Civil Court: $140.00,
- Supreme Court: $210.00.
