Temporary Suspension Extends Time to Collect Aged Bad Debt

When a debt is owed, there is a fixed time limit, a statute of limitations, to file a lawsuit or an appeal. The length of time to bring the suit varies and is dependent on the type of case. For example, in New York State, most breach of contract cases must be brought within six years from the breach. 

On October 26, 2012, in anticipation of the devastation of Hurricane Sandy, New York Governor Andrew Cuomo issued Executive Order No. 47 temporarily suspending the statute of limitations effective October 26, 2012 as it pertained to actions whose time were to expire effective October 26, 2012 or thereafter. The order extended the time to file the action until further notice.

If your time to bring an action terminated on October, 26, 2012 or thereafter, don’t worry, there is still time to file an action.
